Terms of Service

These Terms of Service (“Terms”) govern your use of tidal.work (the “Platform”), operated by Tidal Work LLC (“Tidal,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms.
1. About the Platform
Tidal is a workplace-transparency platform for working women. We compile companies' family and caregiving benefit policies — such as parental leave, work flexibility, fertility, childcare, and related benefits — primarily from public and official sources, and we let the community help keep that information accurate by flagging corrections, suggesting companies to add, and sharing anonymous first-hand experiences. We also display open roles sourced from third-party job boards and companies' own career pages. The Platform is provided for informational purposes only and is not legal, financial, employment, or other professional advice.
2. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent that you meet this requirement.
3. User Accounts
To contribute to the Platform, you must create an account using a valid email address. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use at support@tidal.work
We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Contributions
4.1 What You May Contribute
You may contribute to the Platform by: (a) sharing an anonymous experience about working at a company; (b) flagging or verifying policy information (flagging what you believe is inaccurate, outdated, or wrong, optionally with a short explanatory note); and (c) suggesting a company to add. You do not submit company policy data directly — Tidal compiles and maintains that data. Anything you contribute must be truthful and based on your genuine first-hand experience or on legitimate, lawful sources (such as a company's own published materials), and not on confidential, proprietary, or unlawfully obtained information.
4.2 What You May Not Submit
You agree NOT to submit content that:
- Is false, misleading, or fabricated
- Violates any confidentiality agreement or non-disclosure agreement
- Contains personal identifying information about specific individuals
- Is defamatory, harassing, or constitutes targeted harassment of any company or individual
- Violates any applicable law or regulation
- Is submitted in bad faith or as part of a coordinated campaign to manipulate Platform data
4.3 Your Representations
By submitting content, you represent that: (a) the information is accurate to the best of your knowledge; (b) you have the right to share the information; and (c) your submission does not violate any third-party rights or applicable law.
4.4 License to Your Contributions
By submitting content, you grant Tidal a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your contribution on the Platform. You retain ownership of your contributions.
4.5 Content Removal
We reserve the right to remove any content at our sole discretion, with or without notice. We are not obligated to review all content before it appears on the Platform.
5. Platform as Intermediary (Section 230)
Tidal operates as an interactive computer service and information content provider as defined under Section 230 of the Communications Decency Act. Tidal is not the publisher or speaker of user-submitted content. We are not responsible for content submitted by users, though we reserve the right to remove content that violates these Terms.
6. Anonymity
The Platform is built to protect contributor anonymity. Anonymous experiences are stored with no link to your account or identity — we do not record which account posted an experience, so a given experience cannot be associated with you, including by us or in response to legal process. Other contributions (such as policy flags, verifications, and your contribution count) are disassociated from your account using one-way cryptographic hashing for abuse-prevention purposes only and cannot be reversed to reveal your identity, and company suggestions are stored with no account link. No system is perfectly secure, so you should never include information that could identify you or another person in anything you submit. See our Privacy Policy for details.
7. Accuracy of Information
Policy information on the Platform is compiled by Tidal primarily from public and official sources and is kept current with the help of community corrections (flags). We do not independently verify every detail, and information may be incomplete, outdated, or inaccurate. Job listings are provided by third-party job boards and companies' own career pages; Tidal is not the employer or recruiter, does not endorse any listing, and does not guarantee that listings are current or accurate. Experiences reflect the personal opinions and accounts of the individuals who shared them, not Tidal. Do not rely solely on Platform information when making employment, legal, or financial decisions — always verify directly with the relevant company. Tidal is not responsible for decisions made based on Platform information or third-party listings.
8. Intellectual Property
The Tidal name, logo, platform design, and original content created by Tidal are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from Tidal's proprietary content without written permission.
9. DMCA Takedown Procedure
If you believe that content on the Platform infringes your copyright, you may submit a DMCA takedown notice to legal@tidal.work. Your notice must include:
- Your contact information (name, address, phone number, email)
- Identification of the copyrighted work you claim has been infringed
- Identification of the material on the Platform that you claim is infringing, with sufficient detail for us to locate it
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
- Your physical or electronic signature
If your content is removed due to a DMCA notice, you may submit a counter-notice to legal@tidal.work that includes your contact information, identification of the removed material, a statement under penalty of perjury that the material was removed by mistake or misidentification, and your consent to jurisdiction in the federal district court for the judicial district in which your address is located. We will investigate and respond to all valid DMCA notices within 10 business days.
10. Prohibited Conduct
You agree not to:
- Scrape, crawl, or systematically extract data from the Platform without permission
- Attempt to gain unauthorized access to any part of the Platform
- Use the Platform to harass, threaten, or harm any individual or company
- Circumvent or disable any security or access control features
- Use automated tools to submit bulk content or manipulate Platform data
- Impersonate any person or entity
- Reverse-engineer or decompile the Platform
- Conduct unauthorized security testing
- Participate in coordinated inauthentic behavior
11. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. Tidal disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the fullest extent permitted by law, Tidal Work LLC and its members, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, even if advised of the possibility of such damages. Our total liability shall not exceed $100 or the amount you paid to use the Platform in the past 12 months, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tidal Work LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your contributions; (c) your violation of these Terms; or (d) your violation of any third-party rights.
14. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. Arbitration shall take place in California.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Jury Trial Waiver: You and Tidal waive the right to a jury trial for any disputes covered by this arbitration agreement.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Informal Resolution Period: Before initiating arbitration, you agree to first contact us at support@tidal.work and attempt to resolve the dispute informally for at least 30 days. If we are unable to resolve the dispute informally, either party may then proceed to arbitration.
15. Premium Features
The Platform is currently free to use. We may introduce optional paid features or premium tiers in the future. If we do, separate pricing and terms will apply and will be clearly communicated before any charges are incurred.
16. Termination
We reserve the right to suspend or terminate your account and access to the Platform at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, the Platform, or third parties. Where practicable, we will notify you via email at the address associated with your account. If your account is terminated, you may appeal the decision within 30 days by contacting support@tidal.work.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
18. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email of material changes. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
